MILWAUKEE (CBS 58) -- The man accused of killing a Milwaukee County Courthouse public safety officer made his first court appearance Thursday, May 14. 

Cash bond was set at $250,000 for 29-year-old Preston Underwood. Police say Underwood shot 56-year-old Dennis Johnson last Friday, May 8. 

Johnson was driving 53-year-old Darrin Sutton to pick up his children when a shootout began. Underwood is accused of then following Johnson and firing into his vehicle. 

The Milwaukee County Courthouse security guard was killed. Sutton and his two children were not hurt. 

"What's even sadder is this case involves two events," said Hon. Barry Phillips in court Thursday. "One can argue in the first event, Mr. Underwood has a right to defend himself. He went from allegedly self-defense to a murder offense because the victim and co-defendant drove away."

Sutton is also expected in court this week. He's charged with possession of a firearm by a felon. 

Underwood will be back in court next Thursday, May 21.
