Underwood faces the most serious charge, that of first-degree intentional homicide.
Johnson, who was driving a black Jeep Grand Cherokee, was shot once near Teutonia and Chambers at around 5:08 p.m. and died at approximately 5:28 p.m.
According to the complaint, the conflict started near 12th and Locust where an argument broke out between Sutton and relatives. Surveillance video reportedly shows Johnson attempting to de-escalate the situation before returning to the Jeep and driving away with Sutton and his two children as passengers.
The complaint alleges Underwood then chased the Jeep in a white GMC Yukon and fired a single shot through the passenger window that struck Johnson.
Underwood also faces charges of attempted first-degree intentional homicide for allegedly firing at Sutton during the initial confrontation, as well as two counts of recklessly endangering safety for the children in the vehicle, according to the complaint.
Sutton is charged with possession of a firearm by a felon. The complaint says Sutton fired his weapon during the confrontation on 12th Street but did not fire at the scene of Johnson's death.
