Milwaukee man charged with homicide by intoxicated driving in fatal crash

MILWAUKEE (CBS 58) — A 23-year-old Milwaukee man is facing five felony charges after prosecutors say he caused a fatal crash while intoxicated before fleeing the scene.

According to court records, Alan V. Ontiveros is charged with:

  • Homicide by intoxicated use of a vehicle(Up to 25 years in prison and a $100,000 fine)
  • Second-degree reckless homicide(Up to 25 years in prison and a $100,000 fine)
  • Hit-and-run resulting in death(Up to 25 years in prison and a $100,000 fine)
  • Knowingly operating a motor vehicle without a valid license causing death(Up to six years in prison and a $10,000 fine)
  • Homicide by intoxicated use of a vehicle with a prohibited alcohol concentration(Up to 25 years in prison and a $100,000 fine)

The charges stem from a crash that happened shortly after 1:15 a.m. Sunday, June 21 near 11th Street and W. Greenfield Avenue.

According to the criminal complaint, officers with the Milwaukee Police Department arrived to find a head-on crash involving two vehicles and several legally parked vehicles that were struck by the force of the collision.

While one officer rendered aid to the victim, another pursued Ontiveros, who investigators say fled the scene on foot. The victim, identified as 47-year-old Faisal Hussain, died from his injuries.

Investigators say Ontiveros showed signs of impairment, including the odor of intoxicants, bloodshot and glassy eyes, slurred speech and difficulty maintaining his balance. Officers also learned he did not possess a valid driver's license.

Authorities allegedly found an open can of vodka seltzer inside the vehicle, and a subsequent blood draw showed Ontiveros had a blood alcohol concentration of 0.136.

According to the complaint, Ontiveros told investigators he drank several beers and vodka seltzers at a nearby bar between 11 and 11:30 p.m., estimating he consumed five or six alcoholic drinks in about an hour before the crash.

Ontiveros is scheduled to make his initial appearance in Milwaukee County court Friday morning.

The investigation remains ongoing.
