WAUKESHA, Wis. (CBS 58) --One of the girls accused in the Slenderman stabbing case is appealing her sentence.

Both Anissa Weier and Morgan Geyser were committed to mental institutions for stabbing a classmate in 2014.

Geyser was committed to the maximum sentence of 40 years in a mental institution, but on September 28 an appeal was filed.

“The appeal will address any of the errors that we identified during the time that we looked over her file, and it doesn't exclusively have to focus on her commitment,” Matthew Pinix, Geyser’s Attorney, said.

Pinix said the reason for the appeal will be revealed in the first briefing which they have to file within 80 days.

“A brief is an argument,” Pinix said. “It's a written argument that explains our position as to why we think that her rights were violated or something went wrong in the process that she's entitled to relief.”

Pinix says it could take close to a year until we learn the court’s decision.

If Geyser wins the appeal, the case will return to Waukesha County court for more proceedings.
