Milwaukee boy accused of fatally shooting mother fights to send case back to juvenile court
CBS 58 MILWAUKEE (CBS 58) -- There are new developments in the case of a Milwaukee boy accused of fatally shooting his mother when he was just 10 years old.
The boy, now 13, is charged with first degree intentional homicide in the 2022 shooting. Police say he killed his mother over a video game.
During a court appearance Friday, Feb. 13, prosecutors said they will appeal a recent ruling form the Wisconsin Court of Appeals.
The boy is currently charged as an adult, and his attorneys are fighting to send the case back to juvenile court.
Earlier this month, judges ruled in his favor, reversing a decision to keep the case in adult court.
Friday, the state confirmed it will file an appeal with the Wisconsin Supreme Court.
A status hearing is now set for Feb. 26.
