Federal judge won't issue temporary stay on ruling allowing gay marriage

MADISON -- U.S. District Judge Barbara Crabb made history when she ruled Wisconsin's same-sex marriage ban unconstitutional. Days later she is refusing to issue a temporary stay that would block same-sex marriages in Wisconsin.

Judge Crabb says the state's request for a stay has no grounds, because there is no ruling to stay at this point. 

Some counties began issuing marriage licenses to same-sex couples minutes after news of Judge Crabb's ruling was reported. Milwaukee and Dane County have married over 300 couples in just a few days after Judge Crabb's ruling. \"They [Milwaukee and Dane County Clerks] did not act I told them they could. I never told any county clerk they could issue licenses.\"

Lawyers representing the plaintiffs said Judge Crabb's ruling also didn't say clerks couldn't issue licenses.

The Wisconsin Attorney General J.B. Van Hollen filed an emergency motion with a federal appeals court based in Chicago to halt the issuing of marriage licenses to same sex couples.
