No criminal charges filed in Delafield fire

DELAFIELD- Waukesha County District Attorney Brad Schimel has decided not to file any criminal charges in the death of Sarah Brucker.

Brucker died in a house fire in early August in the town of Delafield.

Schimel wrote that, while the cause of the fire remains undetermined, there is no evidence that it was intentionally set.

Furthermore, there was no evidence of any type of accelerant and that there were no individuals who were identified as having the motive, opportunity and means to have started this fire nor to have intentionally killed Brucker. 

He explained that during the initial stages of the investigation, he was concerned about the inability of Brucker to exit the residence and that it is likely that it may never be known exactly why she was not able to make her way to the nearby exit, but it is clear that she died as a result of soot and smoke inhalation, and there are no other evident injuries.  

The mother of two had a very high blood alcohol concentration, which Schimel said may have played a role in her inability to exit.

He theorizes that it is also possible that the building simply went up in flames so quickly that she was not able to see or panicked.
