South Milwaukee teen found currently 'not competent' to stand trial after being charged with own grandmother's death
SOUTH MILWAUKEE, Wis. (CBS 58) -- A South Milwaukee teenager has been found currently 'not competent' to stand trial after being charged as an adult with first degree homicide in his own grandmother's death.
In the afternoon of Aug. 27 of last year, authorities were called to 17th Ave. and Oak Street where they found a 68-year-old woman not breathing.
She was taken to a local hospital but died three days later.
Officials identified her as Elizabeth Totsky, noting her neck showed signs of strangulation.
On Sept. 3rd, the South Milwaukee Police Department arrested 15-year-old Edward Barbara - Totsky's grandson.
According to court records, Barbara claimed Totsky was having a seizure but later admitted to strangling her.
Totsky's husband told police she had reported being strangled by her grandson months prior.
On Friday, Jan. 31, a competency report revealed that the court found Barbara currently 'not competent' to stand trial and that he lacks the capacity to understand court proceeds or assist in his own defense.
But records say that Barbara is likely to restore competency.
For now, he will be placed in institutional care by the Department of Health and Family Services.
He has a review hearing set for May.
