RACINE, Wis. (CBS 58) -- A Racine County sheriff's deputy made his first court appearance Thursday, Sept. 17, for charges related to an accidental shooting.

Thirty-five-year-old James Lehman of Union Grove appeared out of custody in Racine County intake court, where he was given a $10,000 signature bond.

Lehman is accused of accidentally shooting a 40-year-old man and 7-year-old boy while at a youth turkey hunt with his 3-year-old daughter.

It happened in April of this year at Cherry Lake Sedge Meadow State Natural Area.

According to the criminal complaint, Lehman told wardens that when he thought he saw a turkey, he held up a semiautomatic shotgun for his 3-year-old daughter, and they pulled the trigger.

Several pellets fired from the gun hit a man and his son. The complaint says Lehman knew the man and ran over to apologize.

The 7-year-old boy's family told investigators he had surgery in June to remove embedded pellets from his head, and three pellets still remain lodged in his skull, brain, and near his spinal cord, which can't be removed.

The complaint says Lehman told wardens he was not an experienced hunter, and he did not have a hunter safety certificate due to a military service exemption.

The Racine County Sheriff's Office told CBS 58 Lehman has been on administrative leave from the department since April.

His next hearing is scheduled for Oct. 7.
