Parents charged in death of 4-year-old Dante Campbell

WEST ALLIS, Wis. (CBS 58) -- The parents of 4-year-old Dante Campbell are now charged with his death.

Charlotte Kurek, 31, faces two charges: chronic neglect of a child and chronic neglect of a child-consequence is death.

Davario Cruz, 21, faces the following charges:

  • Physical abuse of a child, repeated acts causing death
  • First degree reckless homicide
  • Chronic neglect of a child- consequence is death
  • Physical abuse of a child, repeated acts causing bodily harm
  • Chronic neglect of a child
  • Possession with intent to deliver controlled substance (THC)

Kurek and Cruz have two twin children together, according to the criminal complaint, and Kurek has three additional children from a previous relationship.

Police response to 911 call 

On the date of Dante's death, officers responded to the Dairy Queen parking lot at 108th and Greenfield in West Allis in response to a 911 call involving an unresponsive child. 

A responding officer observed extensive bruising on the child's face, abdomen, legs, and back, according to the complaint, calling it "the most extensive and severe injuries" they had seen on a child. 

When questioned, the complaint says Kurek told officers Dante's bruising was caused by an accidental fall down the stairs the day before. She told officers when the child fell, several items on top of the stairs fell on top of him. She claimed the next morning she discovered Dante face-down in bed, not moving. Kurek said she didn't want her daughter to see, so instead of calling 911 immediately, she first dropped her daughter-Dante's twin sister- at a friend's house. After dropping her off, Kurek called 911 and dispatchers told her to pull over in the Dairy Queen lot as that was the fastest location for first responders to meet her. 

When asked if police could examine the staircase at her residence, the complaint says Kurek declined, saying, "that doesn't sit right with me."

Dante was pronounced dead at Children's Wisconsin the morning of Oct. 18. Prosecutors say doctors noted extensive bruising to his body, a large abrasion on his shoulder, and puncture wounds to the neck and shoulder.

Officials locate other children 

Investigators went to Kurek's home, where the complaint says a woman outside told them she'd arrived to pick up Kurek's three children. The woman said Kurek had contacted her 20 minutes prior asking her to pick up the kids, according to the complaint.

Police knocked on the door and three unattended children responded, ages 8, 10, and 11.

One of the children said that there was a "big bang" during the night, according to the complaint, and that Kurek and Cruz left the home with the twins, leaving the rest of them locked in a room. 

Officials also went to the home where Kurek had dropped off Campbell's twin sister and asked the child about bruising around her eye. She responded, "Daddy hurt me," according to the complaint. Prosecutors say the child had numerous scratches and bruises on her face and body along with a swollen eye and soiled clothing.

While speaking with Kurek's friend, the complaint says he told investigators that Kurek had called him at 8 a.m. asking to drop off her daughter, telling him, "My son's not breathing, I think he is dead."

Investigators speak with other children 

While talking with the children, the 11-year-old stated, according to the complaint, that his mother knew about the abuse happening to his siblings and did nothing to stop it.

The complaint says Cruz would make Campbell and his twin sister stand on Legos, used a piece of wood from a bed to strike Campbell in the forehead, and one child claimed they witnessed Cruz throw Campbell "all across the room," resulting in bruises all over his body. In another instance, the complaint says Cruz would use his hands and a slipper to strike both twins.

Another child, according to the complaint, witnessed Cruz grab Campbell and throw him against a wall. Campbell would reportedly scream, "Mom, mom!" but Kurek did not stop Cruz. 

One of the children said that Dante "never got a break from being beat" and that Cruz would sometimes lock him in a closet.

According to the 4-year-old twin, Cruz "whooped" her because he was mad at her.

Detectives interview Cruz 

Detectives interviewed Cruz on Oct. 19, during which he -- according to the criminal complaint -- stated Campbell fell down the stairs Oct. 17 while entering the residence. When officials confronted Cruz with the severe number of bruises all over Campbell's body, Cruz responded, "I was just hitting him. Hitting him in the mouth."

Cruz admitted, according to the complaint, in response to Campbell hitting his twin sister, Cruz struck him in the mouth and on the buttocks. On a scale of 1-10, Cruz admitted he struck Campbell as hard as "a 7 or 8."

During the interview, Cruz admitted to striking both twins on previous occasions. He's reportedly used hanger in the past but attempted to minimize the use of a hanger by clarifying that the hanger was made of plastic.

Interview of Kurek

The complaint says Kurek told investigators that on the way to meet first responders, Cruz repeatedly said, "I killed my kid, I want to kill myself."

It goes on to say Kurek admitted that she'd lied about Dante falling down the stairs out of fear, because Cruz keeps guns in the home. 

Kurek said that Cruz was "heavy handed" but believed that she'd addressed the issue with him, according to the complaint.

Court records show initial appearances for both Kurek and Cruz scheduled for Oct. 22.
