MILWAUKEE (CBS 58) -- The second day of the Michael Mattioli trial took place Tuesday, Nov. 7 -- he's the former Milwaukee Police Department officer accused of killing Joel Acevedo while off duty in 2020. 

In court Tuesday, we heard from two of Mattioli's friends who were there the night Acevedo died. 

The first to take the stand was Christopher Peters, who says he has known Mattioli his whole life. He told the state he had only met the victim once before the party at Mattioli's house where Peters said they hung out, drank alcohol and gathered around a bonfire. 

Peters admitted to using drugs but said Mattioli was unaware. 

Milwaukee County Assistant District Attorney Paul Leonard Tiffin: "Did you say how many times you would leave, excuse yourself use a little cocaine and come back, maybe once or twice, you didn't tell anybody what you were doing correct?"

Peters: "Correct."

Mattioli's attorneys then showed the court text messages between him and Acevedo. Acevedo asked about consuming cocaine together. Peters says after falling asleep, he remembers waking up to yelling and then being attacked. 

Peters: "I see Joel and Michael screaming at each other and Michael telling him to leave, and Joel was refusing to leave and him mentioning something about Joel going through his pockets. After that I got punched in the face."

DA Tiffin: "Who hit you?" 

Peters: "Joel, one in the nose and then one right by my eye. I fell backwards into the kitchen knocked off my feet." 

Andrew Janowski was second to take the stand -- a friend Mattioli met through Peters in 2019. 

DA Tiffin: "Who was the aggressor?" 

Janowski: "Joel." 

DA Tiffin: "From the beginning?" 

Janowski: "Yes." 

Janowski said when the fight broke out, he tried not to get involved. 

"Joel was on his stomach and Michael was straddling his back...I placed myself in his legs," Janowski said. "I knew police were on their way, I had just heard call the police, call 911."

The entire 911 call was played in the courthouse and some unredacted bodycam footage of officers arriving at the scene and attempting to resuscitate Acevedo who investigators say had no pulse at the time. 

Later, we hear Mattioli's conversation with an investigator. 

"Why the [expletive] am I being treated like a criminal? I called 911…what the [expletive] is all this about?" Mattioli says in the 911 call. 

Day three of the trial resumes Wednesday morning, Nov. 8 with what we believe to be the last set of witnesses including the medical examiner.
