Kyle Rittenhouse's attorney files motion to dismiss 2 charges against teen

KENOSHA COUNTY, Wis. (CBS 58) -- The attorney for the Illinois teenager charged with killing two people during a protest in Kenosha, filed a motion to dismiss two charges against the teen late Tuesday, Dec. 1. 

Kyle Rittenhouse will appear for his preliminary hearing Thursday, Dec. 3. 

His attorney Tuesday, filed a motion to dismiss two his charges: possession of a deadly weapon by a minor and one of the counts of recklessly endangering safety. 

Prosecutors accuse Rittenhouse of shooting and killing two people and leaving another hurt during those August protests. 

A $2 million cash bond was recently posted for Rittenhouse and he was released from Kenosha County authorities' custody.
