Judge denies Steven Avery's motion for new trial

SHEBOYGAN COUNTY, Wis. (CBS 58) – A judge has denied Steven Avery’s request for a new trial.

Avery's attorney's 1,200 page motion was turned down by a Sheboygan County Judge. The motion claimed among other things that evidence against Avery was planted. 

Avery was convicted in the 2005 murder of photographer Theresa Hallbock and made international headlines by the Netflix series “Making a Murderer.” Brendan Dassey, Avery's nephew was also convicted in her murder. An appeals court heard arguments last week whether his confession should be thrown out.

Avery's lawyer, Kathleen Zellner took to Twitter, saying "The battle continues. We have new evidence & witnesses. An innocent person never quits, nor do we."
