Family of Marine Files Wrongful Death Lawsuit

The family of a Marine veteran who died from a toxic mix of drugs at the VA facility in Tomah has filed a wrongful death lawsuit against the government.

The family accuses VA caregivers of improperly prescribing and giving drugs to Jason Simcakoski, who died in 2014.

They also say the VA failed to provide him adequate emergency care when he was found unresponsive and failed to diagnose his mental health concerns and substance abuse problems.

Simcakoski's wife filed the lawsuit Monday.

The VA's Inspector General ruled last year that deficiencies in care led to Simcakoski's death.

One physician was fired.
