2 charged in Kenosha shooting that killed 16-year-old during alleged gun deal turned robbery

KENOSHA, Wis. (CBS 58) -- A 19-year-old Kenosha man and a 16-year-old Kenosha teen are charged with first-degree intentional homicide and multiple other felonies after prosecutors say a planned gun sale turned into a robbery and shooting that left 16-year-old Isiah Cooper dead and two others injured.

Carlito Ayala faces charges including first-degree intentional homicide as a party to a crime, attempted first-degree intentional homicide, armed robbery with force, possession of a firearm by a felon, and substantial battery, according to the criminal complaint.

Aaron Cumberland, the 16-year-old charged in this case, is facing similar charges.

Investigators say they responded shortly before 8 p.m. on Feb. 4, to reports of multiple gunshots near 7th Avenue and 60th Street. When officers arrived, they found a black SUV with shattered windows and three teens nearby.

One of the teens, identified by family members as Cooper, was on the ground near the vehicle with multiple gunshot wounds to his chest and face. He died at a hospital the next day.

Police say another teen was shot in the chest and shoulder, and the third teen had head injuries and told officers he had been struck with a gun.

Investigators say the group initially told officers they were meeting someone to buy shoes through Facebook Marketplace but later told officers they were buying a gun and planned on stealing it.

One of the teens told officers he planned a gun deal with Cumberland.

Surveillance video investigators obtained showed Ayala and Cumberland leaving an apartment building and walking towards the SUV. Moments later, multiple gunshots can be heard, and Cooper is seen falling to the ground.

After a search at the apartment building, investigators found both Cumberland and Ayala inside. Officers found multiple firearms, including an AR-15-style rifle and handguns, including the one used in the shooting.

Investigators also recovered ski masks and torn fake money inside the apartment.

Cumberland gave detectives several versions of what happened, eventually telling officers that he and Ayala planned to sell a gun and that shots were fired during a struggle inside the vehicle.

Text messages recovered between Ayala’s phone and one of the teens show conversations about taking a gun and using fake money during the planned transaction.

In court, Ayala’s bond was set at $2 million because he is a convicted felon.

“A shooting occurred, people were dying, and anything less than $2 million would be inappropriate,” said the prosecution in court.

Cumberland’s bond was set at $1 million because of his age.

“The reason why this is a $1 million cash bond and not a $2 million cash bond is in light of one, the defendant's age, and based upon, potentially, his criminal history,” said the prosecution in court.

Both Ayala and Cumberland will be in court next week for a preliminary hearing.
