15-year-old charged in connection with fatal shooting of David Krause near Milwaukee's Harbor District

MILWAUKEE (CBS 58) — A 15-year-old Milwaukee teen has been charged in connection with the April shooting death of David Krause near Milwaukee's Harbor District, with prosecutors alleging he was part of a group attempting to rob Krause when he was killed.

Stallone D. Dailey is charged with felony murder, operating a vehicle without the owner's consent as a knowing passenger and arson of property other than a building as a party to a crime.

The felony murder charge carries a maximum possible sentence of 35 years in prison. Dailey was 14 years old at the time of the shooting.

According to a criminal complaint, Milwaukee police responded to 125 E. Greenfield Ave. shortly before 8 p.m. April 14 after receiving multiple 911 calls about a shooting near the Harbor Room.

Officers found Krause outside the bar with a gunshot wound to his chest. He was pronounced dead at the scene at 8:05 p.m.

An autopsy determined Krause died from a single gunshot wound to the chest fired from "contact range." The bullet entered the left side of his chest and exited through his back, according to the complaint.

Investigators said Krause had been out with his girlfriend earlier that evening before asking to be dropped off at a BP gas station near South First and West Mineral streets.

Krause later called his girlfriend and told her he had gotten a ride from four people he had met at the gas station, despite her offering to pick him up, the complaint states.

Surveillance video from the gas station showed Krause eventually getting into a white Hyundai Sonata with several people.

Investigators identified Dailey and 16-year-old Breontae Tyler among the group. Video showed Tyler driving the Sonata away from the gas station around 7:43 p.m. with Krause and others inside, according to the complaint.

About a minute later, surveillance video near the Harbor Room showed the Sonata pull over on East Greenfield Avenue.

Prosecutors say Krause ran from the vehicle toward the entrance of the Harbor Room. Tyler allegedly chased him and grabbed him from behind, while Dailey also got out of the Sonata and chased Krause.

Video allegedly showed Dailey and Tyler struggling with Krause in the alley next to the bar. Investigators said a third person approached but remained several feet away.

Moments later, that person ran from the area and Dailey and Tyler returned to the Sonata, which investigators said was consistent with the gunshot being fired immediately before the group fled.

The criminal complaint does not definitively identify whether Dailey or Tyler fired the fatal shot.

One person interviewed by investigators said there had been a discussion at the gas station about robbing Krause. That person later told police another member of the group said Tyler pointed a firearm at Krause during the attempted robbery and shot him while the two were fighting.

Another person who was inside the Sonata told investigators Krause asked the group for a ride. She said Krause later got out of the car with Dailey, Tyler and another person before she heard a single gunshot.

According to the complaint, she told investigators Dailey and Tyler returned to the Sonata after the shooting. She also alleged Dailey later gave Tyler a lighter to set the stolen Sonata on fire.

Police found the Sonata burning near North 60th Street and West Hope Avenue about 25 minutes after Krause was shot. Investigators determined the vehicle, which had been reported stolen earlier that day, was intentionally set on fire.

A second stolen vehicle, a Hyundai Tucson that investigators said had been traveling with the Sonata, was later found abandoned near West Bender Avenue. The complaint notes the vehicle was recovered less than a tenth of a mile from Dailey's listed address.

Dailey was arrested April 20.

Investigators later showed Dailey's father surveillance images from the BP gas station, and he identified Dailey in the footage, according to the complaint.

During a search of Dailey's residence, investigators recovered what they described as the distinctive sweatshirt he was wearing the night of the shooting. An officer also recovered a watch that appeared to match one seen on Dailey in surveillance video.

Prosecutors allege Dailey, Tyler and another person chased Krause from the Sonata as part of an attempted robbery and assaulted him before Krause was fatally shot.

The complaint states either Dailey or Tyler shot Krause in the chest, causing his death. Dailey was 14 at the time of the shooting and has since turned 15.

Tyler has separately been charged with felony murder, operating a vehicle without the owner's consent and arson in connection with Krause's death.
