MILWAUKEE (CBS 58) -- Attorneys for man shot and seriously hurt by Milwaukee Police in 2017 now want a federal grand jury to investigate the shooting.
Two Milwaukee police officers shot Jerry Smith Jr. three times on a rooftop last August. He didn't have a gun.
The officers were cleared of any wrongdoing in the shooting, but Smith's attorneys say new video shows Smith involved in a fight before he was shot by police.
Smith's legal team says a woman in the video is carrying a large knife and threatened him.
They say the woman is one of the people who claimed Smith had a gun which led to the officer-involved shooting.
"She states she saw the person with the knife. She saw the officer approach the plainclothes detective, pointed out the knife that the person dropped. That plainclothes officer kicked that knife down the sewer," said Daniel Storm, a member of Smith's legal team.
Smith Jr. was partially paralyzed from the shooting.
