MILWAUKEE (CBS 58) – A Milwaukee man is facing a first degree intentional homicide for a New Year’s Day shooting.

According to a criminal complaint, 27-year-old Jose Xavier Hernandez-Vargas shot and killed Jose Quinones-Osorio near 10th St. and Orchard St. around 4:21 a.m.

Court documents say the victim, Quinones-Osorio, had 10 gunshot wounds.

Quinones-Osorio’s girlfriend was found kneeling over his body at the scene. She told police they were driving home from a friend’s house on New Year’s Day when they saw a car blocking the alley to their home.

She told police Quinones-Osorio got out of the car to confront the driver. As he was standing near the vehicle, the car backed up and hit another car in the alley before driving away. After that happened, the owners of the car that was hit came out of their home and asked Quinones-Osorio what happened.

While this was happening, a woman came out of another home and started fighting with the people who were talking to Quinones-Osorio. Court documents say a white SUV then drove into the alley and four Hispanic men got out of the car and began to argue and fight with the others. At this time, around 20 people were fighting and arguing in the alley. Then, Quinones-Osorio’s girlfriend heard six or more gunshots and everyone began to run. She saw Quinones-Osorio lying on the ground and called 911. She tells police she didn’t see who shot him.

Two witnesses told police they saw a man armed with a handgun shoot Quinones-Osorio from behind.

They both identified Hernandez-Vargas as the suspect. He is expected in court on January 17 for a preliminary hearing.
