Judge orders new hearing for demoted Waukesha Fire Chief

WAUKESHA-Hugs, kisses and handshakes for former Waukesha Fire Chief Jesse Alba who's suing to get his old post back.


On Monday, a judge ordered a different panel should determine his fate finding that due process was violated when he was demoted to firefighter.


The disciplinary action came after a former co-worker said Alba pressured her to resign after their affair had ended.


The court ruled the police and fire commission was tainted because of prior dealings with Alba.


But the judge refused the defense request to reinstate Alba as Chief with back pay.


\"Good and bad it was mixed,\" said Alba's attorney Victor Plantinga. \"We're still alive and fighting.\"



The judge ordered the case to be remanded to the city of Waukesha where a new hearing should be held by a new commission.
