Attorneys of former Milwaukee County Judge Hannah Dugan attempt to throw out case, decision in hands of judge

MILWAUKEE (CBS 58) -- A former Milwaukee County judge appeared in court Wednesday morning.

Oral arguments have wrapped at the federal courthouse in Milwaukee, and the case of Milwaukee Judge Hannah Dugan is now in a judge's hands.

The attorneys for Dugan, who is convicted of obstructing federal agents, are looking to have her case overturned or dismissed. 

No cameras were allowed inside the federal courtroom Wednesday as Judge Dugan and her attorneys made another attempt to try to throw out this case. 

Dugan was convicted in December and was set to have her sentencing today. But last week, Judge Lynn Adleman said he wanted to hear oral arguments on a defense motion to reconsider her conviction. 

This comes after months of attempts from her team to reconsider the verdict in her case. 

Dugan's lawyers say a recent decision by the U.S. Circuit Court of Appeals had changed the definition of an ICE proceeding. Prosecutors opposed the motion Wednesday. 

It's now in the hands of the judge, and we are expecting a written decision from him as early as Wednesday afternoon.

If nothing rises from this hearing, and Judge Dugan is eventually sentenced, she could face five years in federal prison and a fine of up to $350,000.
