Complaint: 45-year-old charged after standoff in Cudahy

CUDAHY, Wis. (CBS 58) -- On July 6, Cudahy law enforcement went to the area of E. Henry Ave. around 9:00 p.m. to a complaint of a neighbor causing trouble and damage to property call. 

Two officers arrived on scene and spoke to a resident that reported. He stated he heard a loud crash and went outside to see a large beer bottle and damage to his siding. He saw two white men outside in the backyard of a resident of S. Crosswinds Dr. The two properties share a property line along a wooden fence. 

According to law enforcement, the resident confronted the men who yelled, swore and laughed at him. 

Officers walked to the S. Crosswinds Dr. residence, a side-by-side townhouse with separate living quarters that share a backyard. 

One officer was positioned in the backyard, while another went to the front and knocked on the door several times to no answer. The officer in the backyard could see through a large window a man walking up to the front with a firearm in hand. The officer radioed the information and the other officer saw the man come up and peer through the window on top of the door. 

The officer yelled "it's the police, put your gun down, police," while taking cover behind a tree in the front of the house. Another officer arrived on scene and all three officers took cover behind a squad car. 

Around 10:00 p.m. an officer saw movement in the driveway and switched on his flashlight. Officers see a man carrying a firearm. Immediately officers yelled "Hands, put the gun down," as the man pointed the firearm at them. One officer fired five rounds towards the man and retreated further from the residence. 

Backup arrived and officers formed a perimeter around the home. They learned resident of the property is Jason Rohloff. Officers attempted to call Rohloff around six times. Around 12:00 a.m. he answered and said "I did not shoot an [sic] anyone. I don't want any violence at all. I just want to go to sleep. I don't understand any of the confusion. Please don't confuse anything for violent behavior at all... I was scared about something shooting guns or fireworks at me - you're scaring me." 

Rohloff admitted to drinking since 3:00 p.m. and was confused why police were outside and shouting commands. He claimed to be scared of his "red-necked" neighbors shining flashlights at him and shot fireworks at him. After 30 minutes of talking, negotiators assured Rohloff if he came outside and followed directions, he would be fine. After that three people left the property, Rohloff, his girlfriend and a guest. 

Law enforcement interviewed Rohloff's guest and his girlfriend who stated that they had a party around 3 p.m. and that they both fell asleep around 9:00 p.m. The guest woke up to the police. The girlfriend woke up to Rohloff grabbing his gun from under their bed, and asked what he was doing which he responded, "Don't worry about it." He came in and out of the room several times before he placed the gun back under the bed. 

Rohloff stated that he hosted a party around 3:00 p.m. and that he had plenty to drink as it was a beer tasting party. He didn't recall interacting with his neighbors or throwing a beer bottle. He stated he didn't remember why he grabbed his firearm, but he did arm himself. He said he saw two people near the intersection of S. Crosswinds and E. Henry and that someone pointed flashlights at him and he heard yelling. He didn't know what was said but heard one gunshot and ran back into the house. He unloaded his gun and set it on the kitchen table. 

When asked why he didn't call police after "someone" fired shots at him, Rohloff had no explanation. Rohloff said he surrendered after receiving text messages from a police officer.
