WAUKESHA COUNTY (CBS 58) -- The attorney of the male suspect in the I-94 standoff and officer-involved shooting last week says he does not know where he is or what his condition is.

Nathan Halfman has not yet been charged after police say he pointed a gun at officers, and was shot multiple times following the five hour standoff for allegedly leaving the vehicle with a gun pointed at his female accomplice.

"The reality is, those are very serious allegations that are levied against him, and anybody, when they have serious allegations levied against them, are going to want their lawyer present for any questioning by police because that should be done right," said Attorney Russell Jones.

Jones has been representing Nathan Halfman since a warrant was issued in a case against him out of Fond du Lac County in May for Possession of Narcotic Drugs and Possession of Drug Paraphernalia.

"Which basically means I need to find him," said Jones.

As part of that case, Jones filed a motion to get access to Halfman. Since learning he was involved in the standoff and officer-involved shooting in Waukesha County, Jones said he's been trying to find him.

"When this incident occurred and it was confirmed that he was part of it, I then undertook efforts to try and locate him either in any jail or in a hospital," said Jones.

Jones said he hasn't been able to locate him at any of the hospitals he's reached out to.

"In all cases they either denied he was there or refused to confirm," said Jones.

He said he also reached out to the Wisconsin Department of Justice but is still waiting to hear back.

"Like it or not, every defendant has a right to counsel, their constitutional rights need to be safeguarded, and the reality is Nathan may be in some legal trouble, and he's already got some issues in Fond Du Lac, and all of those require him to have an attorney," Jones said.

Jones said as far as he knows, Halfman's mother does not know where he is.

"As far as I know, his mom does not know where he is or she's not aware of his condition," said Jones.

CBS 58 reached out to the Waukesha County Sheriff's Office multiple times for a response, but have not heard back. The Wisconsin Department of Justice has also not responded to questions about Halfman's location or condition.

CBS 58 also reached out to county jails in Southeast Wisconsin. Halfman is not at any of them.
