Teen charged in fatal Milwaukee shooting to be tried as an adult

MILWAUKEE (CBS 58) — A 16-year-old charged in the killing of a Milwaukee man will be tried as an adult after a judge ruled Thursday that the public's interest outweighed keeping the case in juvenile court.

According to Milwaukee police, 35-year-old David Krause was at a gas station looking for a ride home when he got into a vehicle occupied by several teenagers.

Investigators allege one of the teens shot Krause before setting the vehicle on fire.

During Thursday's waiver hearing, the judge initially said it would be in the teen's best interest to remain in juvenile court. Believing that would be the final decision, members of Krause's family stood up and left the courtroom.

However, the judge continued the ruling moments later, finding that the public's interest outweighed the juvenile's and ordering the case transferred to adult court.

Last week, a judge denied a waiver request for another teen charged in the case, meaning that defendant will remain in juvenile court.

A third teen charged in connection with Krause's death is scheduled for a waiver hearing on Aug. 12.
