KENOSHA, Wis. (CBS 58) -- Two men are facing charges in connection to the shooting death of a 5-year-old in Kenosha.

According to a criminal complaint, 24-year-old Javonn Cannon is facing charges of homicide by negligent handling of a dangerous weapon and possession of THC. 24-year-old Jovonn Cannon is charged with leaving/storing a loaded firearm near a child.

Court documents state the shooting happened at a Kenosha home on Monday. 5-year-old Dakari Weldon was dropped off at a hospital where he later died.

Authorities say Weldon, Jovonn and Javonn were in Jovonn's room cleaning when Javonn said he put Jovonn's gun on the bed. Javonn tells police he did not check to see if the gun was loaded.

Javonn walked away to smoke marijuana and came back to the room to see Weldon playing with the gun. Court documents state Javonn told Weldon to stop and give him the gun, but the child refused. Weldon then put the gun behind his back. According to the criminal complaint, Javonn reached around Weldon to get the gun, when he snatched the gun, it went off.

Javonn tells police he does not know what happened to cause the gun to go off, but his hands were on it. Javonn realized Weldon was bleeding and instead of waiting for an ambulance, Jovonn and Javonn drove to the hospital. At the hospital, Jovonn took a corner too fast and crashed into parked cars. That's when Javonn got out of the car and carried Weldon into the emergency room, court documents state.

Once Javonn saw emergency workers helping Weldon, he left. Javonn and Jovonn later decided they needed to tell police what happened.

Jovonn faces 9 months in prison and up to a $10,000 fine. Javonn faces up to 20 years in prison and $26,000 in fines.

KENOSHA, Wis. (CBS 58) - A man calling himself the grandfather of a 5-year-old boy who was shot and killed in Kenosha, says the shooting was an accident.

“I don’t raise killers, it was an accidental shooting,” said Curtis Cannon, who lives in the home where the boy was shot.

Cannon says his sons were home with the child when he was shot.

“I don’t think the 5-year-old shot himself,” said Cannon, “I wasn’t here to witness it but I’m pretty sure Cory didn’t shoot himself.”

Cory is the boy, who was rushed to the hospital by Cannon’s two sons, but they left the boy there.

Cannon doesn’t know why.  “Maybe they were scared to death, maybe they took him to the hospital because they f**ked up and they didn’t want him to be in pain,” said Cannon.

“It’s stunning, you don’t know what to think,” said Rod Erlandson who lives across the street.

Erlandson says the family was always nice to him.

“Just see the older gentleman on the porch,” said Erlandson, “I wave at him from time to time, he waves back.”

Another neighbor who didn’t want to go on camera says a man in that house saved his son last summer when he was shot.

“He took off his shirt and wrapped it around my son 'til the ambulance got here or he would’ve been dead,” she said.

For now, a grandfather is left dealing with a tragedy.

“I loved him, he was a little kid,” said Cannon.

Cannon says his sons were not arrested, and police confirm they don’t have anyone in custody.

The investigation is ongoing.
