MILWUAKEE (CBS 58) -- The Milwaukee mom accidently shot and killed by her son has been identified as Amber Gray. 

Milwaukee police tell us the man her son was trying to protect her from is now in custody -- 26-year-old Ziare Dalton is charged with felony murder for Gray's death. 

The shooting happened last month near 15th and Cherry St.

Police say Gray's 17-year-old son grabbed a gun in the house and started shooting toward Dalton, because he was hitting Gray. 

Dalton was shot but survived his injuries. 

Gray was hospitalized and later died.
