Man charged after woman reports sexual assault at Pick N Save parking lot on East Lyon
Wisconsin Court System MILWAUKEE (CBS 58) -- A 23-year-old Milwaukee man is charged with second-degree sexual assault, substantial battery and strangulation after a woman reported being attacked Sunday, Sept. 27 at around 2:30 a.m., according to a criminal complaint.
Felipe Lopez-Simon is accused in connection with an assault that began near a bar on E. Brady Street and continued in a car parked at a Pick N Save store near the area of E. Lyon and Van Buren streets.
The woman initially told police that she was walking on N. Warren when a man grabbed her by the neck and forced her into a truck.
In a later interview, she told police she had been out with friends and did not remember leaving the bar, then found herself in the backseat of a vehicle with a man on top of her, according to the complaint. She reportedly told police he held her down, applied pressure to her neck, and threatened to hurt her while attempting to sexually assault her, and that she eventually broke free and ran away.
Two men who saw her running and screaming called police, according to the complaint. A witness and the woman both described the assault to officers at the scene and later at the hospital, where a nurse's exam found injuries consistent with what she remembered.
Detectives traced the car seen in surveillance video to Lopez-Simon through its license plate and matched his description to the one the woman provided. She later identified him in a photo lineup. Officers found Lopez-Simon and took him into custody.
A woman who said she is Lopez-Simon's girlfriend is cited as telling detectives that she noticed a scratch on his face the morning after the alleged assault.
Lopez-Simon has not been convicted. His initial court appearance is scheduled for Friday, Oct. 2.
