Kellner family awarded millions in civil lawsuit

MILWAUKEE -- The jury in the Jared Kellner civil case has reached a verdict awarding the Kellner family $6.8 million. The jury found that contractors shoulder most of the blame for the incident that killed Jared Kellner.

 

In, 2010 Jared Kellner was walking with his friend and his friend's mother when a concrete slab fell from the O'Donnell Park parking garage. Kellner was killed, and his friend's mother lost her leg in the incident.

 

The jury deliberated for a day and a half before their verdict was read. The jury found that Advanced Cast Stone was 88% responsible for the accident. Advanced Cast Stone was found negligent in their work on the O'Donnell Park parking structure.

 

Milwaukee County was found 2% responsible for the incident that caused the death of Jared Kellner. The jury did find the Advanced Cast Stone did breach their contract with Milwaukee County. Milwaukee County was awarded $6 million.

 

Another contractor J.H. Findorff and Sons was assigned the other 10% blame by the jury.

 

Kellner's friend and his mother were both awarded over $1 million in this civil lawsuit. Advanced Cast Stone will be forced to pay $38.9 million as a result of this verdict.

 

\"I just want to say thank you to the jury for all their work,\" Kellner's mother Dawn said after the verdict was read,  \"Thank you to the community for remembering Jared and thank you to people who stood up so it never happens to anybody else or any other family. We keep looking ahead to public safety and make sure we are keeping everybody safe.\"

 

\"Certainly we are disappointed with the result and don't agree with it,\" Advance Cast Stone attorney Matthew McClean told CBS 58 News.

 

He added that they plan to appeal but had sympathy for the Kellner family and Jared's friend and his mother who were hurt in the incident. \"I wish them well.\"
