Judge dismisses lawsuit against Buc-ee's development in Oak Creek

OAK CREEK, Wis. (CBS 58) -- A lawsuit designed to block construction of a Buc-ee's gas station and convenience store in Oak Creek was dismissed Wednesday, Aug. 27. 

A neighborhood group filed the lawsuit. In May, a permit was granted by the Oak Creek Common Council allowing plans to move ahead for a 120-gas pump station at 27th and Elm. 

Complaints from neighbors include the traffic a Buc-ee's would bring and the damage it could do to property values. Their lawsuit was dismissed without prejudice, which means it could be refiled at some point. 

A statement from the City of Oak Creek says they appreciate the judge's decision. The next steps for the project are a final site and architectural review by the plan commission.
