Competency evaluation ordered for 10-year-old accused of murdering mother

MILWAUKEE (CBS 58) -- The 10-year-old Milwaukee boy charged as an adult for shooting and killing his mother appeared in court Friday.

According to the criminal complaint, the boy originally told police he got a gun from his mom's bedroom and that it accidentally went off. But the 10-year-old later told investigators he was aiming at her.

The child's attorney said the criminal complaint is not accurate.

The 10-year-old, charged as an adult, was walked into the courtroom without handcuffs for Friday's preliminary hearing.

His attorney requested a competency evaluation, saying the child doesn't seem to understand what is happening, and may not be able to assist in his own defense.

Judge Jane Carroll granted the competency evaluation.

The 10-year-old remains in juvenile custody under a $50,000 bond.

The next hearing to go over the evaluation is scheduled for Feb. 13.
