UPDATE: Son violates court order, now charged in father's murder

WAUKESHA COUNTY --A simple wellness check turns into a full blown homicide investigation and potentially more.



Village of Summit police went to a home to check on a 60-year-old James Witt a few days ago, that's when they found him dead from a gunshot wound.



They initially arrested his son, 27-year-old Shawn Witt on January 21 for domestic abuse.



He was booked and a restraining order was filed. He was to have no contact with his father. He was then released on signature bond.  But then authorities got a tip to go check on James Witt.  They went to his home Wednesday and found Witt dead just hours after his son was released with a restraining order.



Shawn Witt is set to be charged Friday with first degree intentional homicide, possession of heroin, bail jumping, theft and other charges.



The restraining order violation is another chilling reminder about how little those matter during domestic violence cases.




\"We have two counts of bail jumping,\" Leslie Boese from the Waukesha County District Attorney's office said.  \"He was also ordered as a condition of his release to have no contact with James Witt or his residence.  We tell people it's a piece of paper, still need to be diligent, we offer them resources.\"



Witt was in court Friday afternoon at 1:15. He's being held in the Waukesha County jail.
