Driver charged with two counts of reckless homicide in Muskego bicyclist deaths

Brett Hartley has been charged with two counts of second degree reckless homicide for hitting and killing two bicyclists on June 6 on State Highway 36 in Muskego.

Witnesses told police, Hartley was deviating from his lane onto rumble strips before the accident.

Hartley was hyperventilating and dry heaving at the scene. He told police he had fallen asleep while driving. He denied consuming any alcoholic beverages, but stated that he had been up for 24 hours without sleep.

He had been driving for an hour and half from Richfield when the accident happened.

Both of the passengers in his Jeep were asleep at the time of the accident.

Hartley had started to drive the passengers from a party in Richfield the night before to his house in Milwaukee. He had asked the passengers to stay at his house because he was tired, but one of the passengers requested to be taken back to her residence in Waterford.

The woman from Waterford told police she had asked if he was ok before driving her and was told by other passenger he was ok.

One of the bicyclists was deceased at the scene and the other was taken to Froedtert Hospital in an attempt to provide life saving measures.

The bikers had left around 6:00 am on bikes to Burlington on Highway 36.

A witness at the scene told police, Hartley had told her, \"Oh My God, I fell asleep, I'm so sorry, I fell asleep.\"

Hartley was taken to Waukesha Memorial Hospital for a legal blood draw and physical exam.

His blood alcohol level was 0.52.

Officers had to wake Hartley up when he arrived at the Police Department after the hospital visit.
