Trial begins for Milwaukee man accused of killing 13-year-old boy

MILWAUKEE -- 77-year-old John Spooner's trial is set to finally begin after the Milwaukee County Courthouse was temporarily closed by a weekend electrical fire. Spooner is accused of killing his neighbor 13-year-old Darius Simmons in 2012.

According to the criminal complaint, Spooner was the victim of several burglaries and believed Simmons took part in at least one of those. Spooner confronted Simmons with a firearm as the teen attempted to pull in a garbage bin from the street curb. 

The complaint says Spooner asked the teen for his stuff back. Simmons and his family denied taking anything from Spooner. Spooner allegedly pulled out a gun and shot the 13-year-old.

If convicted of First Degree Homicide, Spooner could spend the rest of his life in prison.
