Family of 13 year old Milwaukee boy shot and killed speaks at vigil

Just one month after a teenager's family moves to a South side Milwaukee neighborhood, police say, his next door neighbor shot him dead. Darius Simmons family spoke at a heart wrenching vigil near W. Arrow and 20th Street where Darius Simmons, 13 was gunned down.

Relatives says Darius was taking the trash out on Thursday when he was shot twice. His mom saw the whole thing. "His mom wants everyone to know. He had his hands up standing in front of him when he shot him. He turned to run. He shot him again in his back," says Darius' Aunt, Betty McCuiston.

Neighbors say earlier that week someone stole from Darius' next door neighbor John Spooner's home. According to court papers, Darius' mother heard Spooner ask her son for his stuff back. The boy told him he didn't have anything. That's when the family says the man took the law into his own hands.

"He done killed my nephew at 13! He's 75. He done live his life and some more time! It don't make no difference to him," says Darius' uncle, Leon Larry.

The victim's family says Darius was at school when someone broke in to Spooner's home. Spooner is now charged with first degree intentional homicide.
