Boy accused of sexually assaulting four year old child appears in court

CEDARBURG -- The 12-year-old boy accused of sexually assaulting two four-year-old children at the Family Tree Learning Center in Cedarburg appeared in court. He's charged with two count of child sex assault.

The 12-year-old plead not responsible by reason of mental disease or defect. A judge ordered a psychological examination to evaluate the child's mental competency.

The 12-year-old confessed to giving one of the victims candy to keep them from telling on him.

The 12-year-old's mother 38-year-old Trista Ziehr is charged with failure to report child abuse for not alerting authorities about an alleged sex assault between her son and a four-year-old boy at the day care she owns.

The complaint says the mother of the four-year-old victim called Ziehr on April 10th to report her son had been touched several times by an older child at the daycare. Ziehr allegedly told the parent that the alleged assailant was going to therapy.

The parent didn't hear from Ziehr after that conversation, so they contacted police. Ziehr told police she didn't know she was required to report allegations to law enforcement.

If convicted, Ziehr faces up to six months in jail.

Ziehr's has been in the news before. She is the mother of 14 year Cody Reetz, the young boy strangled by his step father in a local Wal-Mart parking lot four years ago.
