SAN JOSE, Calif. (AP) -- Last minute talks failed to reach a deal, so the patent trial involving Apple and Samsung is set to go to a jury.

Apple argues that Samsung should pay it $2.5 billion for "ripping off" its iPhone and iPad technology.

Samsung's view is just the opposite. It claims Apple should pay $400 million for allegedly stealing its technology.

One patent expert says the case will likely boil down to whether jurors believe the Samsung products at issue in the case look and feel almost identical to Apple's iPhone and iPad.

The judge called Samsung's Galaxy 10.1 tablet computer "virtually indistinguishable" from Apple's iPad and banned its sale in the U.S. until the case is resolved.
